ANALISIS JUAL BELI PAKAIAN THRIFTING DISHOPEE MARKETPLACE PERSEPEKTIF UNDANG-UNDANG NO.8 TAHUN 1999 TENTANG PERLINDUNGAN KONSUMEN DAN HUKUM ISLAM

This research is motivated by the existence of fraudulent elements that occur in severaldishopee marketplace accounts. In practice, the seller does not explain or describe theactual condition of the goods being traded. It is as if the seller is hiding the defects inthe item.The formulations in this study are: 1) How is the analysis according to Law no. 8 of1999 concerning Consumer Protection against the practice of buying and sellingthrifting clothes in the shopee marketplace?. 2) How is the analysis according to Islamiclaw regarding the practice of buying and selling thrifting clothes in the shopeemarketplace?. The objectives of this research are: 1) to find out how the analysisaccording to Law Number 8 of 1999 concerning consumer protection against thepractice of buying and selling clothes thrifting in the shopee marketplace. 2) to find outhow to analyze according to Islamic law on the practice of buying and selling thriftingclothes in the shopee marketplace.The type of research in this research is qualitative research. Based on its activities, thisresearch is called library research, while the data analysis technique uses contentanalysis techniques.The results of this study indicate that: 1) the analysis of the practice of buying andselling thrifting clothes in the shopee marketplace is not in accordance with LawNumber 8 of 1999 concerning Consumer Protection in Article 4 paragraphs 2,3,4,7, and8 regarding consumer rights. . 2) an analysis of the practice of buying and sellingthrifting clothes at the shopee marketplace is not in accordance with Islamic law,especially on the terms of buying and selling in Islam, because there is still an elementof ambiguity (gharar) and the absence of khiyar rights given to the buyer, namelykhiyar 'aib.
